A federal magistrate in Oregon has recommended the dismissal of a $1 billion lawsuit filed by the Klamath Tribes.
The tribes sued PacifiCorp for building dams on the Klamath River. The tribes say the dams violated their treaty rights by destroying fishing grounds.
But U.S. Magistrate John P. Cooney said the tribes waited too long to file the suit. Since dam constructed ended in 1967, the tribes should have sued within six years, the magistrate said.
A final decision on the suit will be made by a federal judge.
