The state of South Dakota is asking the Oglala Sioux Tribe to extradite two tribal members accused in a beating that occurred off the reservation.

The request is the first in more than 10 years, the state attorney general said. In that case, the tribe ended up turning over a tribal member, who escaped on furlough, to the state.

In the current case, Dakota Garnier, 19, and Dirk Garnier, 20, are charged in Fall River County with aggravated assault in the beating of Matthew Pepin, 18, on June 2. Dakota Garnier also faces attempted first-degree murder. A third man, George E. Birlew, 23, is currently in custody and awaits trial for the incident.
