The Cherokee Nation's highest court heard oral arguments on Tuesday in a same-sex marriage case.
Two female tribal members were awarded a license to marry. But a tribal judge blocked the license and the Cherokee Nation Council then passed a law outlawing same-sex marriages.
Kathy Reynolds, 28, and Dawn McKinley, 33, say they should have the same right to marry as other Cherokee citizens. They say their marriage isn't harming anyone.
The council's lawyer argued the other side of the case. He said tribal laws have always defined marriage as between a man and a woman even though those terms weren't specifically used.
