Hearing scheduled in Aquinnah Wampanoag Tribe gaming case

A federal judge has scheduled a hearing in the gaming dispute between the state of Massachusetts and the Aquinnah Wampanoag Tribe.

The state sued the tribe in order to block a proposed Class II facility on the reservation. The tribe had the case moved to federal court, where it will stay to resolve gaming issues under the Indian Gaming Regulatory Act of 1988.

The hearing takes place August 6, The Cape Cod Times reported. The town of Aquinnah and the Aquinnah/Gay Head Community Association are seeking to join the dispute because they were parties to an agreement with the tribe that led to the Massachusetts Indian Land Claims Settlement Act of 1987.

In 2004, the Massachusetts Supreme Court ruled that the law subjects the tribe to state jurisdiction. Since the gaming case is in federal court, there could be a different outcome.
