The Iipay Nation of Santa Ysabel in California has launched Desert Rose Bingo, an online gaming site.
The Iipay Nation of Santa Ysabel is defending its online bingo operation from a lawsuit filed by the state of California. The tribe launched Desert Rose Bingo earlier this month. The site is limited to Class II games, which aren't covered by the Class III gaming compact and aren't subject to state jurisdiction under the Indian Gaming Regulatory Act. "Offering legal IGRA Class II bingo gaming is neither a breach of the tribe’s Class III Tribal-State Compact (“Compact”) of 2003 with the state nor a violation of the federal Unlawful Internet Gambling Enforcement Act," the tribe said in a court filing today. The state is asking a federal judge to put a halt to the site. A motion hearing has been scheduled for December 4 at the federal courthouse in San Diego.
