Pojoaque Pueblo sues New Mexico for gaming compact talks

Pojoaque Pueblo is accusing the state of New Mexico of bad faith Class III gaming compact negotiations.

In a lawsuit that was filed in federal court last month, the tribe claims the state wants a greater cut of gaming revenues and insists on provisions not related to Class III gaming. The complaint says the demands violate the Indian Gaming Regulatory Act.

"The State demands that Pojoaque revenue sharing to the State increase by an effective rate of 32.5 % from its present 8% to an amount at or above 9.5% of net win (gradually increasing to an amount at or above 10.5 % over the 23-year life of the compact) and offers no substantial or meaningful benefit to the Pueblo to provide consideration for, or otherwise justify, the proposed tax," the complaint states.

The tribe's current compact expires June 30, 2015.
