The Oregon Court of Appeals has upheld the authority of the governor to enter into Class III gaming compacts. A group of property owners sued Gov. John Kitzhaber (D) when he signed a compact with the Confederated Tribes of Coos, Lower Umpqua and Siuslaw Indians back in 2003. After a decade of litigation, the appeals court determined that the Legislature authorized the governor to enter into gaming agreements. The court also said the Indian Gaming Regulatory Act authorizes tribes to engage in the same types of gaming that are legal in Oregon. Turtle Talk has posted documents from the case, Dewberry v.
