Group seeks to intervene in Massachusetts gaming law case
Wednesday, September 19, 2012
The Aquinnah
Wampanoag Tribe of Massachusetts isn't the only one trying to join a lawsuit that challenges
H.3702,
the state's gaming law.
The tribe filed a motion to intervene, claiming it has a right to a casino under the Indian
Gaming Regulatory Act.
The Aquinnah/Gay Head Community Association also wants to join, to argue that the tribe isn't entitled to gaming.
The lawsuit was filed by K.G. Urban Enterprises, a non-Indian developer. KG says provisions in H.3702 that reserve a casino for "a federally recognized tribe" violate the U.S.
Constitution.
