Kialegee Tribal Town considers appeal over disputed gaming site

Tribal Town might appeal a decision that bars gaming on an Indian allotment in Oklahoma, an attorney said.
Judge Gregory Frizzell blocked the Red Clay Casino after determining that the tribe lacked jurisdiction over the allotment, a key requirement of the Indian
Gaming Regulatory Act.
"I know the question of appeal is being discussed," attorney Dennis Whittlesey told The Tulsa World.
An appeal would go the 10th Circuit Court of Appeals.
Meanwhile, Frizzell said the tribe could engage in other non-gaming activities at the site. Whittlesey wouldn't say what might be in the works.
