Judge won't reconsider ruling to bar Kialegee Tribal Town casino
Tuesday, July 31, 2012
A federal judge says he won't reconsider a decision that bars the Kialegee
Tribal Town from operating a casino on an Indian allotment in Oklahoma.
Judge Gregory Frizzell blocked the Red Clay Casino after a trial in May. He issued a written preliminary injunction on July 20.
The allotment is owned by two sisters who were members of the Muscogee Nation before they became members of the Kialegee Tribal Town.
Frizzell said that wasn't enough for the Kialegees to assert jurisdiction over the site, a key requirement of the Indian
Gaming Regulatory Act.
