New York Gov. Andrew Cuomo (D) said he is open to non-Indian casinos in Seneca Nation territory.
The tribe was promised regional exclusivity in its Class III gaming compact.
But the tribe says the state has violated the deal and has withheld about $400 million in casino revenues.
The dispute is under mediation but Cuomo said he will consider other options if it can't be resolved. He is already pushing for non-Indian casinos near New York City.
"It depends. We'll have to see where we are [next] year on what the adherence to the contract is," Cuomo said, The Buffalo News reported.
