A federal judge has dismissed a lawsuit aimed at blocking the Seneca Nation off-reservation casino in Buffalo, New York.
Daniel Warren challenged the constitutionality of the Indian Gaming Regulatory Act, the tribe's Class III gaming compact and a state law that authorized the compact. Judge William M. Skretny rejected all of the complaints in a 34-page decision on Monday.
“This affirmative ruling benefits the Seneca Nation and its Buffalo Creek Casino, and justifies our confidence in the Nation’s approach to our business in downtown Buffalo,” President Robert Odawi Porter said in a press release.
The tribe operates the Buffalo Creek Casino in a temporary building in Buffalo.
In a separate lawsuit that is still pending, gaming opponents say the land doesn't qualify under IGRA.
