Judge tells casino to stop using Shakopee Tribe's 'Mystic' name


A federal judge has ordered the operator of a gaming facility in Nevada to stop using "Mystic" name because the Shakopee Mdewakanton Sioux Community of Minnesota owns the trademark.

The tribe opened the Mystic Lake Casino Hotel in 1992. Templeton Gaming knew "Mystic" was trademarked but opened the Mystic Lodge Casino in 2000 anyway.

"Here, there is no question that the plaintiff owns a valid and protectable mark," Judge James Mahan wrote in his decision on Monday, Vegas Inc reported. "Congress has afforded 'nationwide protection to registered marks, regardless of the areas in which the registrant actually uses the mark.'"

Templeton is appealing the preliminary injunction that Mahan issued, Vegas Inc reported.
