Quapaw Tribe immune from lawsuit in casino product dispute

The Quapaw Tribe of Oklahoma is immune from a lawsuit under federal trademark law, a judge ruled last month.

Specialty House of Creation Inc. accused the tribe of infringing on a trademark for a slot machine card holder. The counterfeit product was used at the Downstream Casino Resort, according to the company.

Judge Gregory Frizzell did not rule on the merits of the case. In a January 27, 2011, decision, he said the tribe has not waived its immunity for patent infringement claims.
