It looks like the Shingle Springs Band of Miwok Indians of California will face a lawsuit in state court over a deal with its former gaming partner.
The tribe went to federal court in hopes of blocking a lawsuit filed by Sharp Image Gaming Inc. But Judge Frank Damrell Jr. dismissed the tribe's case last week, The Sacramento Bee reported.
The state courts have already ruled that the tribe waived its sovereign immunity in a deal with Sharp Image Gaming. A trial is scheduled for February 2011.
Sharp Image claims the tribe violated the deal by opening the Red Hawk Casino with Lakes Entertainment.
