Another California tribe wins case over slot machine cap

Another California tribe has won a lawsuit over the limits the state placed on the number of slot machines at tribal casinos.

The San Pasqual Band of Mission Indians signed a Class III compact in 1999. The deal promised each tribe up to 2,000 slot machines but the state imposed a cap that has since been rejected in at least three different cases.

In the San Pasqual case, Judge Larry Burns said the cap should be 42,700 machines. That's lower than the 56,000 machines that Judge William McCurine put in his decision last week involving the Rincon Band of Luiseno Indians.

A third case, involving tribes from northern California, is currently before the 9th Circuit Court of Appeals. The just in that case set the limit at 42,700 machines.
