NIGC tells Fort Sill Apache Tribe to close casino


The National Indian Gaming Commission has issued a notice of violation (NOV) to the Fort Sill Apache Tribe of Oklahoma.

The NIGC says the tribe cannot engage in gaming on trust land in New Mexico. The notice tells the tribe to stop offering Class II games at the Apache Homelands Entertainment Center.

At issue is whether the casino site qualifies under the Indian Gaming Regulatory Act. In general, trust land acquired after 1988 cannot be used for gaming.

The Apache site was acquired in 2002, long after the 1988 deadline. But the tribe said it qualified for an exception in Section 20 of IGRA that applies to tribes that were restored to federal recognition.

The NOV, however, says the tribe does not meet the exception for restored tribes and "must immediately cease all gaming operations" at the facility.
