The 9th Circuit Court of Appeals lifted an injunction in a charity bingo case in California.
The charities and churches have been operating electronic gaming machines that tribes and the state say are illegal. A judge issued an injunction that protected the charities while the case was being litigated.
But on March 27, the 9th Circuit said state law “unambiguously” banned the machines, The Capitol Weekly reported. The California Tribal Business Alliance said the decision sent a clear message that the charities won't win the case.
"It’s just a shame that we had to take this much effort to stop what are so obviously illegal slot machines," Allison Harvey, the executive director of the CTBA, told the Weekly.
The CTBA was not a party to the case but asked the state to take action against the charities and churches.
The case is Video Gaming Technologies v. Bureau of Gaming, No. 08-16736.
