The Stockbridge-Munsee Band of Mohican Indians of Wisconsin filed suit against the Bush administration over the rejection of its off-reservation casino in New York.
The tribe filed a land-into-trust application for a casino in the Catskills. In January, it was rejected by the Bureau of Indian Affairs because officials said it was too far from Wisconsin.
The lawsuit against the Interior Department says the decision was based on a faulty "guidance" memorandum that was developed without tribal consultation or public review.
The Stockbridge-Munsees lived in New York before being removed to Wisconsin.
