The Seneca Nation of New York vowed to keep its off-reservation casino open despite renewed attempts by casino opponents to shut it down.
The Buffalo
Creek Casino is operating in a temporary facility in downtown Buffalo. The tribe says it is confident the site is eligible for gaming under the Indian
Gaming Regulatory Act.
The site was taken into trust after 1988 but the tribe says it satisfies the land claim exception in Section 20 of IGRA. A federal judge, however, disagreed in a case filed by casino opponents.
The National Indian Gaming Commission
issued a notice of violation to the tribe after the court ruling but the facility remains in operation. Casino opponents say the NIGC should be held in contempt for failing to shut the casino down.
