9th Circuit allows San Pasqual compact lawsuit

The San Pasqual Band of Mission Indians can sue the state of California over the tribe's Class III gaming compact, the 9th Circuit Court of Appeals said in an unpublished decision.

The tribe signed a compact in 1999 that allowed up to 2,000 Class III machines. But a statewide cap imposed by the Gambling Control Commission prevents the tribe from reaching the limit at the Valley View Casino.

At issue was whether the lawsuit could proceed without the involvement of other tribes that signed the compact. In two similar cases, the 9th Circuit has said the case can go forward.
