Opponents of the off-reservation casino owned by the Seneca Nation of New York said they have heard nothing from the Bush administration about the status of the facility.
Attorney Cornelius D. Murray said his clients will go back to court to force the closure of the Buffalo
Creek Casino in downtown Buffalo. A federal judge ruled that the 9-acre site does not qualify for gaming under the Indian
Gaming Regulatory Act.
The tribe purchased the land for the casino with funds authorized by an act of Congress. Judge William M. Skretny said the law was not a land claim settlement that would give the tribe an exemption under Section 20 of IGRA.
The tribe has said it will not close its temporary casino or stop work on a permanent facility. The site is Indian Country, Skretny acknowledged in his ruling.
