The San Pasqual Band of Mission Indians is asking the 9th Circuit Court of Appeals to reinstate a lawsuit over the number of slot machines at its casino.
The tribe's 1999 compact theoretically allows 2,000 slot machines at the Valley View Casino. But the state Gambling Control Commission says the tribe can only have about 1,500 machines.
A federal judge dismissed the case but the tribe has appealed to the 9th Circuit. The California Nations Indian Gaming Association has filed a brief in support of the San Pasqual Band.
State Sen. Jim Battin, a Republican, has introduced a bill to ensure all tribes with a 1999 compact can operate 2,000 slot machines.
