The Menominee Nation of Wisconsin wants a federal judge to stop the Interior Department from making a decision on an off-reservation casino.
In a court filing, the tribe says it was told by a Department of Justice lawyer that the government won't voluntarily halt work. So the tribe is asking for a temporary restraining order.
The tribe fears outgoing Interior Secretary Dirk Kempthorne, an opponent of off-reservation gaming, will reject the casino despite local support. Kempthorne plans to stay in office until president-elect Barack Obama is inaugurated on January 20, 2009.
