The Mashantucket Pequot Tribal Nation has appealed an order from the National Labor Relations Board to negotiate with the United Auto Workers.
The tribe says employees at Foxwoods Resort Casino should organize under tribal law. The NLRB has said the tribe is subject to federal law.
The tribe wants the 2nd Circuit Court of Appeals to resolve the dispute. The D.C. Circuit Court of Appeals, in a case involving the San Manuel Band of Mission Indians of California, ruled that tribes fall under the National Labor Relations Act under certain conditions.
