Fort Sill Apache Tribe says gaming site is legal

The Fort Sill Apache Tribe of Oklahoma says its off-reservation gaming site in New Mexico is legal.

Chairman Jeff Houser said the 30-acre parcel near Deming in southern New Mexico was taken into trust in 2002. But it's not clear if the land was taken into trust for gaming purposes.

The tribe plans to offer Class II games at the site. An 11,000-square-foot temporary facility could be open as early as March.

The tribe's headquarters in Apache, Oklahoma, are about 750 miles away.
