Texas cheers ruling against Kickapoo gaming

Officials in Texas praised a federal court ruling that blocks the Kickapoo Tribe from Class III gaming without a state compact.

The state has refused to negotiate a compact. The Interior Department said it would step in and allow the tribe to offer certain Class III games.

But the 5th Circuit Court of Appeals on Friday said the department's procedures are beyond the scope of the Indian Gaming Regulatory Act. The court said the state can't be kept out of the Class III process.
