The Choctaw Nation can be sued for an accident at its casino, the Oklahoma Court of Civil Appeals ruled on October 25.
Under its Class III compact with the state, the tribe waived its sovereign immunity and consented “to suit in a court of competent jurisdiction.” At the time of the December 2005 accident, that meant the state courts, the Civil Appeals court said.
Danny and Pat Dye of Arkansas say Danny Dye was injured in the parking at the Choctaw casino in Pocola. They are seeking damages for negligence, bodily injury and loss of companionship.
The case is Dye et al v . Choctaw Casino, et al, No. SD-104737.
