County sues DOI over Indian land determination


Amador County in California has filed suit against the Interior Department to challenge the Indian lands determination for the Ione Band of Miwok Indians.

When he was serving as Interior's solicitor for Indian affairs, Carl Artman said the tribe could open a casino on 228 acres that it wants placed in trust. Artman, who now heads the Bureau of Indian Affairs, said the tribe qualifies as a "restored" tribe under Section 20 of the Indian Gaming Regulatory Act. [PDF: Indian land determination].

Amador County claims the decision is arbitrary, capricious and contrary to law in a lawsuit filed on March 16. The suit also alleges the tribe is not federally recognized [More Documents].
