The Oneida Nation of New York is seeking a waiver to allow smoking at the Turning Stone Resort and Casino.
The tribe is appearing to concede that the casino falls under the state's smoking law.
The land on which the casinos is located is not held in trust.
The tribe asked Oneida County for a waiver, citing millions spent on an air-cleaning system. The county has granted similar waivers for other businesses.
