The Rhode Island Supreme Court will hold oral arguments on August 15 on the Narragansett Tribe's casino proposal.
The court will consider whether the proposal is legal under the state constitution. The tribe and its partner, Harrah's Entertainment, plan to operate the casino in conjunction with the state.
The court considered the issue last year and struck down the casino plan because it left out the state. Lawmakers passed a new bill to address the concerns.
The tribe has to comply with state law as a result of its settlement act. A Congressional rider also specifically excludes the tribe from the Indian Gaming Regulatory Act.
