The Rhode Island House voted 42 to 26 on Wednesday to ask the state Supreme Court to issue an advisory opinion on the Narragansett Tribe's casino proposal.
The decision, which doesn't require Senate approval or the governor's signature, is aimed at avoiding legal problems that derailed the tribe's proposal last year.
The court said any form of gaming not "operated" by the state violated the state constitution.
The tribe and its partner Harrah's Entertainment have since changed their plan to a partnership with the state. But Gov. Don Carcieri (R) still says he will fight it.
