The Wyandotte Nation of Oklahoma has filed a lawsuit against the National Indian Gaming Commission over the tribe's out-of-state casino.
The tribe opened a Class II facility on trust land in downtown Kansas City, Kansas. But in an unpublicized decision, the NIGC said the land was not eligible for gaming.
Earlier this year, state authorities raided the facility, claiming authority to prosecute violations of state crime on trust land. A federal judge in Kansas ruled that the state lacked jurisdiction but refused to reopen the casino.
The NIGC suit was filed in Washington, D.C., but could be transferred to the Kansas court.
