A federal judge refused to seat President Bush's pick to the U.S. Civil Rights Commission on Monday, saying the White House had no right to have another member removed.

U.S. District Judge Gladys Kessler said all members of the Democrat-leaning commission are entitled to six-year terms as Congress intended. As a result, Bush's pick, a conservative African-American lawyer named Peter Kirsanow, could not replace Victoria Wilson.

Wilson was appointed by former President Bill Clinton in 2000 to replace a dead member. The Bush administration took the position that her term expired when the deceased's would have.
