Judge strikes down affirmative action

MARCH 28, 2001

A federal judge on Tuesday ordered the University of Michigan to change its law school admissions policy, ruling it unconstitutional.

US District Judge Bernard A. Friedman's decision conflicts with another federal court ruling issued by US District Judge Patrick J. Duggan which upheld UMich's undergraduate policy. But it falls in line with a 5th Circuit Court of Appeals ruling which struck down the admissions policy of schools in Texas, Mississippi and Louisiana.

Yet another affirmative action challenge is pending in the 11th Circuit. Meanwhile, the 9th Circuit last year found the admissions policy at the University of Washington Law School to be constitutional.

The differences in law will probably be resolved by the Supreme Court.
