A bill aimed at making sure the University of North Dakota doesn't lose a benefactor's money as a result of the debate over its "Fighting Sioux" nickname might not be necessary said an attorney on Wednesday.

Pat Seaworth, attorney for the State Board of Higher Education said the school is already protected from losing money promised by benefactor Ralph Engelstad. Engelstad said he would stop construction on an arena he is donating to the school if they dropped their "Fighting Sioux" nickname.

But a contract he signed prevents that, said Seaworth. The Board voted to keep the name the day after Engelstad sent them a letter threatening to stop the project.
