N.Y. city seeks reconsideration of Oneida case

TUESDAY, JULY 22, 2003

A case over the status of Oneida Nation-owned land could head to the Supreme Court before the end of the year.

A lawyer for the city of Sherrill says he will ask the 2nd Circuit Court of Appeals to reconsider its ruling favoring the tribe. The court, in a 2-1 decision, said land purchased within ancestral territory is considered Indian Country, free from state jurisdiction and taxation.

If the city's request fails, the lawyer says the case will be appealed to the Supreme Court.
