Senate Republicans lost a 55-44 vote on Wednesday, their fourth attempt to break a Democratic filibuster against appeals court nominee Miguel Estrada.

Estrada would sit on the D.C. Circuit Court of Appeals, which hears a number of Indian law-related cases. The court unanimously affirmed the first Cobell decision in February 2001.
