A federal judge in South Dakota has scheduled a hearing to address a tribal request to halt construction of a shooting range on sacred land.

Five tribes and an Indian activist group have asked the court to prevent the Department of Agriculture from using federal funds to help pay for the range, near Sturgis. They say the development will violate environmental and historic preservation laws and their right to practice their religion.

The tribal plaintiffs are the Northern Cheyenne of Montana and the Rosebud Sioux, Crow Creek Sioux and Yankton Sioux tribes of South Dakota. The court yesterday gave permission to the Standing Rock Sioux Tribe of South Dakota to intervene as a plaintiff.

The case is Northern Cheyenne v. Martinez, No. 03-5019. It has been assigned to U.S. District Judge Karen E. Schreier.
