Senate Republicans lost an attempt on Thursday to stop a Democrat filibuster of an appeals court nominee.

The vote was 55 to 44, five votes short of the 60 needed. Republican leaders said they would keep voting until Miguel Estrada is confirmed as a judge to the D.C. Circuit Court of Appeals.

The court hears a large number of cases affecting the federal agencies, including Indian-related ones. The court affirmed the right to an historical accounting of the Indian trust in February 2001.

In related federal judiciary news, the Senate Judiciary Committee approved the nomination of Tim Tymkovich to the 10th Circuit Court of Appeals. The vote was a 10-6, with all Democrats present voting no.

The 10th Circuit hears cases affecting tribes in New Mexico, Colorado, Oklahoma, Kansas, Utah and Wyoming.
