S.D. tribe won't force members to testify

FRIDAY, FEBRUARY 7, 2003 A grand jury in South Dakota is set to hear testimony in a case alleging voter fraud among American Indians. Ten witnesses are from the Crow Creek Sioux Tribe but the tribe won't allows the state to serve subpoenas on them. The tribe said their appearance before the grand jury is voluntary, according to a memo cited by The Sioux Falls Argus Leader The state tried to delay a preliminary hearing due to the difficulty. But a judge yesterday refused to grant the request. The state has filed a suit in federal court to force the tribe to accept the subpoenas. Get the Story:
