WEDNESDAY, DECEMBER 4, 2002

The Miami Nation of Oklahoma is suing the Department of Interior over a legal opinion that said the tribe has no right to a parcel of land in Kansas.

Interior Solicitor Bill Myers said the Maria Christiana Reserve was not Indian land for purposes of gaming and was not under the control of the tribe. The 35-acre allotment, which is held in restricted status, is under Bureau of Indian Affairs supervision.

The suit is the latest legal action in a long-running dispute over the land. The 10th Circuit Court of Appeals in a recent ruling said the tribe's claim had essentially been extinguished.
