IHS malpractice lawsuit settled

The federal government settled a malpractice lawsuit filed against the Indian Health Service for $3.5 million.

At age 4, Eric Dan went to the the Northern Navajo Medical Center in Shiprock, New Mexico, for an appendectomy. He developed brain damage and is quadriplegic.

The clinic is the same one involved in the death of a Navajo man who died of the hantavirus. That case went to court but a federal appeals court struck down a $2.1 million judgment.
