A Kansas state judge has delayed the state's prosecution of a company accused of failing to pay taxes for distributing gas to the Prairie Band Potawatomi Nation.

Davies Oil supplies gas to to the tribe's convenience store. It is one of two companies Kansas officials have targeted for Indian Country commerce.

A federal judge next February will hear the Prairie Band case. A separate case involves the Winnebago Tribe of Nebraska, which distributes gas to three other Kansas tribes.
