A federal judge has denied American Indian Movement activist and actor Russell Means a spot on New Mexico's ballot for governor.

Means tried to run as an independent after parting ways with the Libertarian Party. But he failed to turn in his required 5,000 signatures on time, missing a deadline by literally minutes.

U.S. Circuit Judge Paul Kelly Jr. ruled the state didn't discriminate against Means because of his third-party status and prior conviction. New Mexico law prohibits felons from public office.
