Animal-rights activists are appealing a federal judge's decision not to halt the whale hunt of the Makah Nation of Washington.

The appeal would go to the 9th Circuit Court of Appeals. The court two years ago invalidated a study which authorized the hunt, delaying the tribe for several months.

After an expanded hunt was approved, the activists filed suit. U.S. District Judge Franklin Burgess in Washington issued a preliminary injunction in the case but declined to extend it because he said the groups didn't meet the necessary threshold.

The tribe's tradition dates back thousands of years. The hunt was resumed in 1999 after a 70-year hiatus.
