Appeals court orders release of water for tribe
Tuesday, April 27, 2004

The 9th Circuit Court of Appeals on Friday issued an order to restore flows to the Trinity River in northern California.

The temporary order comes in litigation involving the Hoopa Valley Tribe. The tribe wants the court to uphold a Clinton administration decision in late 2000 to restore flows to the river to help salmon and fulfill treaty rights.

Water users filed suit to stop the decision and received a delay. The tribe has been pressured to settle with the Westlands Water District but the tribe has rejected the offers so far. The tribe met with Sen. Dianne Feinstein (D-Calif.) on Monday to discuss the case.
