2. ACTION ALERT:
Template Letter for Written Comments: Treasury’s Adoption Tax Credit Implementation Consultation
On September 15th, the U.S Department of the Treasury held a virtual consultation on implementing Sections 70402 and 70403, “Recognizing Indian Tribal Government for Purposes of Determining Whether a Child has Special Needs for Purposes of the Adoption Credit.”

To support Tribal participation in this consultation process, NAFOA has prepared a template letter for Tribes to utilize when submitting written comments to Treasury. Tribal input is critical to ensure that Treasury effectively implements the Adoption tax credit in a manner that accurately reflects the needs and perspectives of Tribal nations.

Comment deadline: October 10, 2025, at 11:59 pm Alaska time. You can submit written comments at tribal.consult@treasury.gov.

3. POLICY:
Continuing Resolution Passes House, But Fails in Senate
Last Friday, the House passed a Continuing Resolution (CR) to maintain government funding through November 21st. The bill passed by a vote of 217-212, largely along party lines, with two Republicans voting against, and one Democrat voting in favor. The “clean” CR would extend funding at current levels for the first seven weeks of Fiscal Year 2026, which begins October 1st. The passage provides House Appropriators more time to complete work on the remaining nine appropriations bills. The House is scheduled to be on recess next week for Rosh Hashanah, putting pressure on the Senate to pass their CR and prevent a government shutdown before the Oct 1st deadline.

In the Senate, funding measures from both parties failed to achieve the 60-vote threshold needed to overcome a filibuster. With the Senate out of session next week, there’s a narrow window to pass an appropriations measure and avoid a government shutdown.

NAFOA will continue to monitor and provide updates on potential impacts to Tribal funding.

4. MEETING:
Financial Literacy and Education Commission (FLEC) Public Meeting on September 24th 2025
Wednesday, September 24, from 10:00 a.m.–11:45 a.m. EST

Secretary of the Treasury Scott Bessent will chair the meeting.

The meeting will focus on payments fraud and feature panel discussions on national trends in payments fraud and federal agency efforts to implement Executive Order 14247, Modernizing Payments To and From America’s Bank Account.

5. JOB OPPORTUNITY:
Summer Law Clerk 2026, Yuhaaviatam of San Manuel Nation
Reporting to the Deputy General Counsel and under the direct supervision of designated attorneys, the Summer Law Clerk performs a range of legal duties on an as-needed basis, such as reviewing, revising and developing Tribal government ordinances and related policies, drafting pleadings and memoranda, conducting research and analysis, initially reviewing and revising contracts, preparing government resolutions, requests for approval, and accompanying presentations for Tribal leadership, and providing recommended courses of action based on the preceding.

The role provides other professional-level non-legal research and assistance supporting a team of attorneys to enable the efficient and effective delivery of legal services to Tribal government and enterprise partners.
