The U.S. Supreme Court hears arguments in Haaland v. Brackeen on November 9, 2022.

The outcome of the case will determine whether the Indian Child Welfare Act (ICWA) is constitutional. The law was enacted by the U.S. Congress in 1978 to keep Indian children connected to their tribes and their communities.

Non-Indians and conservative state politicians are seeking to invalid the entire law, in order to prevent tribes from having a say in child welfare proceedings. A decision is anticipated before the end of the court’s current session in the summer of 2023.
