South Dakota hospital to refile lawsuit against IHS in new court

The Bennett County Hospital & Nursing Home in South Dakota will refile its lawsuit against the Indian Health Service in a new court.

The hospital sued the IHS last year over $1.6 million in unpaid bills. The complaint was filed in federal district court in South Dakota but it will be moved to the U.S. Court of Federal Claims.

The hospital often provides service to members of the Oglala Sioux Tribe who would otherwise receive care from the IHS.
